TERMS AND CONDITIONS

SECTION A: EQUIPMENT HIRE

​1. Loss or Damage

​Hired equipment is the full responsibility of the Hirer. Any loss and/or damages will be charged

​back to the Hirer.

​2. Public liability insurance, injury or damage to hirer or third persons or property

​The hirer shall not have any claim against the Owner for loss or damage suffered by the hirer as

​a result of the Hirer’s use of the equipment and further the Hirer will indemnify the Owner

​against any claim made against the Owner by a third person or other losses arising out of the

​use of the equipment by the hirer.

​3. Late Return

​If we are not notified of a late return prior to the return date listed in the agreement, hire will be

​charged at twice the original hire rate.

​4. Accessories

​Any of the standard accessories or cables missing will be charged for.

​5. No assignment of Hire Agreement

​This agreement is personal to the Hirer of the equipment. The person signing this document for

​and on behalf of the Hirer (if not personally the Hirer) confirms that he or she has the authority

​of the Hirer to make this contract on the Hirer’s behalf and that he is not empowered by the

​Hirer to break this agreement. The person so signing hereby indemnifies the Owner against all

​losses and costs that may be incurred as a result of the person so signing the agreement failing

​to have such power of authority.

​6. Owners right to terminate the hire

​The Owner reserves the right to terminate the hire at any time and will not be responsible to the

​Hirer for any loss he may claim to have suffered in respect of such a termination.

​7. Care of equipment and breakdowns

​a. The Hirer shall take proper care of the equipment and shall indemnify the Owner against any

​damage or loss arising out of its use or theft.

​b. The Hirer warrants he or she is competent and qualified to use the equipment in the way that

​it is designed.

​c. Breakdowns through misuse shall in no way shorten the term of period of hire charging.

​d. It is the Hirer’s responsibility to satisfy himself or herself that the equipment is suitable for the

​use intended and it is used in a way that complies with all statutory and legal requirements.

​e. The equipment does not purport to be in brand new condition or equal to brand new

​condition but all items are understood to be in good working condition at the time of hire.

​f. The Owner is not liable for any loss or damage caused by the Hirer as a result of a breakdown

​of equipment, however caused.

​g. The Hirer shall be liable for any loss or damage caused by overloading, connection to

​incorrect voltage, mysterious disappearance, theft, fire, damage in transit, loss in transit or

​misuse in any way.

​8. Determination of value for damage or loss

​The value for loss or damage will be assessed based on the brand new replacement value or

​any repair work necessary.

​9. Delivery and removal of equipment

​The Hirer authorises the Owner or his agent full access to property where the equipment may

​be sited to deliver or recover the equipment in hire.

​10. Freight and delivery charges

​Responsibility of the Hirer, unless otherwise arranged prior to the Hire. The Owner accepts no

​liability or responsibility for any delays or freight insurance, or any damages arising from delays

​in delivery or transit time.

​11. Delivery and collection chargers

​Responsibility of the Hirer, unless otherwise arranged prior to the Hire. The

​Owner accepts no liability or responsibility for any delays or freight insurance,

​or any costs incurred in freight.

​12. Possession

​The hirer must not transfer possession of the equipment stated above for the duration of the

​hire, unless agreed upon in writing with Cue-Go Limited.

​13. Cleaning Charge

​A cleaning charge will apply if the dry hired equipment (including cables) requires cleaning

​upon return.

​14. Excessive noise direction

​The equipment hired must be used in a manner that does not cause nuisance to neighbours

​and nearby properties. If an excessive noise direction notice is received, speakers must be

​turned off immediately and The Owner should be notified.

​15. Cancellation

​Events cancelled 7 days prior to the start date of the event, Cue-Go Limited reserves the right

​to charge all reasonable costs incurred in relation to the event up to this point. Events

​cancelled within 7 days of the start day of the event, will attract up to 50% of the total charge

​of the entire event. Events cancelled within 48 hours of the start day of the event, will attract up

​to 100% of the total charge of the entire event. The start date of the event is defined as the first

​day equipment left, or was going to leave, the Cue-Go workshop for your event, or the first day

​any billable work was, or was going to be, undertaken for your event.

​16. Payment Terms

​Full payment must be made within 14 days following the last day of the event, unless a prior

​arrangement has been made in writing. If full payment has not been made by this deadlines,

​interest will be charge at 10% per month, or part thereof on the outstanding balance. Where a

​50% deposit is specified in the Quote summary, please ensure this payment is made 14 days

​prior to any work being done, or equipment being delivered, for the event.

SECTION B: SERVICES & SERVICE+

​1. Service timeframes

​Cue-Go reserves the right to appoint its own timeframe for a selected service, so far as

​reasonably practicable. Where a client has requested a specified timeframe, Cue-Go will aim

​to adhere to this time.

​2. Subscriptions

​Where Cue-Go Ltd provides subscription-based services for a product, the user agrees to a

​minimum term of 12 months, unless otherwise specified. All subscriptions are charged through

​Stripe, and will appear on your bank records as “CUE-GO”, repeated inquiries regarding this

​statement may incur administrative fees. Unless otherwise specified, Cue-Go reserves the right

​to charge a subscription at the specified interval.

​3. Refunds

​Cue-Go retains the discretion of refunds, and is not obligated to refund a purchase or

​subscription if a service has already been performed, or has been booked and is cancelled

​within 7 days. Cue-Go will process refunds as credit towards a future purchase, and will not

​refund any cash amounts. All refund and credit applications will incur a $30 administrative fee.

​4. Service+ Product Exclusions

​Product exclusions may apply to the discount rates set out in the “For Companies” and “For

​Venues” subscription plans. Included at all times in the product exclusions are:

​- Items that are already on sale at the manufacturer or warehouse distributor for any

​amounts.

​- Consumables, including any items below a RRP value of $100.

​- Any items that the warehouse distributor or manufacturer does not allow further discounts

​on.

​- All Apple products, including but not limited to, the MacBook Pro or Air

​series, all iPads, all iPhones, all iMacs, Mac Studio, Mac Studio Displays

​and accessories.

​- Any other product that Cue-Go does not deem fit to discount at the time

​of purchase, discounting is at full discretion of Cue-Go. Cue-Go does not accept liability

​for price increases or decreases caused by manufacturer disruption.

​5. Services

​Advertised prices for Service+ members is entirely dependent on the current economic

​situation, and takes up to 25% off the standard hourly rate for technicians ($38/hour), unless

​otherwise quoted.

​6. Event Coverage

​The classification of ‘minor event’ needs to meet the following conditions:

​- The venue cannot hold more than 100 patrons, if inside, or 300 patrons, if outside.

​- The event is a single-day event, and will not require more than 8 hours of labour, if more

​than 8 hours of labour is required, it will be billed at the conventional $38/hour unless

​otherwise specified in an agreement.

​- No more than 1 technician is required to assist with the event.

​The classification of a ‘major event’ needs to meet the following conditions:

​- The venue cannot hold more than 650 patrons, or 1000 patrons, if outside.

​- The event is no longer than 3 days, any additional days will be billed at the standard dayrate.

​- No more than 2 technicians are required to assist with the event.

​7. Emergency Technical Supplies

​The 24/7 technical supplies or services offered in some Service+ plans contain the following

​categories:

​- Emergency Technical Supplies includes cables, hardware, tools, or consumables. It does

​NOT include any equipment valued over $100, lighting, or audio-visual equipment.

​- Emergency Technical Services includes labour of less than 30 minutes, and is intended to

​quickly fix broken wiring or educate technical operators that aren’t employed by Cue-Go.

​8. Discounted Service Rates

​Estimations for the ‘For Artist’ Discounted Service Rates is based on a yearly breakdown, where

​the artist has at least one show per month, and saves on average $40 (which equals to approx.

​1 free hour of labour, sponsored as pro-bono). Discounted Service Rates cannot be claimed in

​one go, and advertised values are not a guarantee of discounts collected by the artist. Savings

​discounts cannot be exchanged for cash, or any other form of payment from Cue-Go to the

​client.

SECTION C: CUE-GO COMMERCIAL

​1. Product Purchasing

​Cue-Go completes all product purchasing as a reseller to MDR Sound & Lighting Limited and

​Surplustronics Limited. As such, any marketing material used by Cue-Go to promote brands

​such as (not limited to), Chauvet DJ, Chauvet Professional, EuroTruss, BeamZ, and Chamsys, is

​not endorsed by either MDR Sound & Lighting Limited or Surplustronics Limited. All pricing is at

​the discretion of Cue-Go, and is directly correlated to market pricing set by our warehouse

​partners.

​2. Returns and Refunds

​Returns and refunds are accepted for faulty goods that are covered under the manufacturer’s

​warranty, since Cue-Go is not the primary merchant and only a reseller, warranty claims will be

​processed by the primary merchant (MDR Sound & Lighting or Surplustronics). Cue-Go accepts

​no liability for damaged goods during shipping, faulty goods that are not covered under

​warranty, or goods damaged by the client. Any disputes will be processed to the

​corresponding merchant. Where refunds are offered, and administration fee from the primary

​merchant may be deducted, Cue-Go will only refund the amount that has been approved by

​the primary merchant.

​- All refund requests must have their original packaging, Cue-Go cannot accept items that

​aren’t in their original packaging.

​3. Installations

​Cue-Go offers discounted installation pricing for Service+ “For Venues”

​subscribers. Cue-Go accepts full responsibility for faulty installations, and

​replacements or gift cards will be issued if a fault has been found during the

​installation. Cue-Go will not refund cash amounts for faulty installations. Disputes will be

​handled by an independent party (in most cases, a representative from MDR).

​4. Credit Limits

​Cue-Go does not offer credit accounts at this point in time, this means that all invoices will be

​due within 14 days of issue, and may incur late fees after the 20th of the next month (after

​issue). Late fees will correspond to late fees introduced by the primary merchant, and will

​include an administration fee of 5% per month.

​5. Debt & Default

​All equipment that is delivered prior to an invoice being paid is under the ownership of Cue-Go

​Limited, and the client acknowledges that Cue-Go is at liberty to remove any and all

​equipment that has not been paid for, from the client’s property.

​- If the client refuses to pay, Cue-Go is at liberty to launch legal action in order to receive

​compensation for losses and damages.
